IRS releases guide on 100% bonus depreciation aircraft eligibility

The IRS has issued a Notice that provides additional guidance on bonus depreciation for certain aircraft. Notice 2026-11 clarifies that 100% bonus depreciation may still be available for some aircraft delivered on or after Jan. 20, 2025, if the purchase agreement was made before the date. Bonus depreciation applies to certain aircraft purchases mostly used for business travel. It provides guidance on whether an aircraft qualifies for the additional first-year depreciation. The guidance provided is consistent with NBAA's 100% Bonus Depreciation, Advanced Technical Implications resource, which was provided after the One Big Beautiful Bill Act of 2025 passed. The bill reinstated 100% bonus depreciation for aircraft that were purchased and put in service on or after Jan. 20, 2025."Business aircraft owners require a detailed factual analysis in order to present accurate tax returns. There are advanced technical positions that support eligibility for 100% bonus depreciation despite challenging facts, whether the aircraft has already been delivered or is yet to be delivered," said David Shannon, partner at Lewis Brisbois and chair of the firm's business aviation practice, according to NBAA.RELATED STORIES:NBAA Tax Committee offers members a summary of the Big Beautiful Bill on aviationWhat the House's 'Big, Beautiful Bill' does for aviation andamp; can it survive the Senate?House advances bipartisan bill that would restore 100% bonus depreciation through 2025Taxpayers may choose, under transition provisions, to apply the 60% rate instead of the 100% rate to aircraft placed in service during their first tax year ending after January 19, 2025.
